Child Support
Our firm can help you with establishing a child support order or modifying child support.
Child support will be ordered in a divorce where there are children under the age of 18. Child support can also be ordered in situations other than divorce.
Where the non-custodial (possessory conservator) parent’s net resources are $7,500 or less (or an adjusted amount based on the statutory formula), then the court will order child support in an amount outlined in the statute.
The statute outlines the following “matrix”:
- One Child: 20% of Obiligor’s Net Resources
- Two Children: 25% of Obligor’s Net Resources
- Three Children: 30% of Obligor’s Net Resources
- Four Children: 35% of Obligor’s Net Resources
- Five Children: 40% of Obligor’s Net Resources
- Six or More: Not less than the amount for five children.
It is possible for the parties to agree to an amount outside the guidelines. If the parties do agree to amount outside the guidelines, the court will still determine if it is in the best of the child(ren).
